Registering a business as a creator: do you need one - and how?

As soon as you regularly earn money with content - whether brand deals, affiliate links or donations - your hobby turns into an activity carried out with the intention of making a profit. And then the question arises: do you need a business (Gewerbe)? This overview explains clearly when yes, when no, and how the registration works.

Business or freelancer - what is the difference?

The tax office (Finanzamt) distinguishes between freelance and commercial activity. Freelancers (Freiberufler) are typically 'catalog-like' professions - artistic, writing, teaching. Most creators fall into a gray area: purely promotional activity (promoting products, affiliate, classic influencer collaborations) generally counts as commercial (gewerblich). Purely artistic or journalistic content can be freelance.

  • Commercial (gewerblich): product placements, affiliate marketing, merch sales, classic advertising collaborations.
  • More likely freelance: independent artistic, writing or teaching content.
  • Mixed form: anyone doing both often has to separate them - here a tax advisor's view is especially worthwhile.

From when do you have to register a business?

The business registration (Gewerbeanmeldung) is due as soon as you permanently carry out a commercial activity with the intention of making a profit - not only above a certain turnover. There is no 'exemption limit' below which you have to do nothing at all: even small, regular income from advertising can be subject to registration. A one-off incidental earning is something different from a recurring activity.

How to register your business - step by step

  1. 1Visit the trade office (Gewerbeamt) of your city or municipality - many offer registration online. Cost: usually around 20-60 euros.
  2. 2Fill out the 'business registration' form (Gewerbeanmeldung, GewA 1): describe the activity (e.g. 'online marketing/influencer activity').
  3. 3After registering, you automatically receive the 'questionnaire for tax registration' (Fragebogen zur steuerlichen Erfassung) from the tax office (online via ELSTER).
  4. 4In the questionnaire you decide, among other things, on the small-business regulation (Kleinunternehmerregelung) - more on that in a moment.
  5. 5Wait for your tax number (Steuernummer) - only with it may you issue correct invoices.

Small-business regulation: sensible for most creators

In the tax questionnaire you can choose the small-business regulation (Kleinunternehmerregelung). Then you don't charge value-added tax (Umsatzsteuer) and save yourself a lot of bureaucracy - as long as you stay below the turnover limits. What does it all cost you?

The business registration itself is cheap at around 20-60 euros. Trade tax (Gewerbesteuer) only applies from an annual profit of 24,500 euros (allowance for natural persons) - below that you pay none. So for most starting creators the effort stays manageable; more important is to set it up cleanly from the start.

  • Waiting too long: whoever registers only after years risks back payments and trouble.
  • Not documenting income: keep a simple income-and-expenses overview from day one.
